Official response of the information service of the Andijan State Medical Institute to the appeal of Mominjonova Feruza, nurse of the Artificial Kidney Department of the Andijan State Medical Institute Clinic

In her audio message, the petitioner Mominjonova Feruza said that the senior nurse of the Artificial Kidney Department of Andijan State Medical Institute clinic is putting a lot of pressure on the sanitary workers and nurses, the reason is that Yusupova Dildora contacted the Ministry of Health and exposed the “bad deeds” of the senior nurse Alimova Kamola and these were confirmed in the examination, she colluded with the head doctor of the clinic, unfairly rotated the entire artificial kidney department said that it was ordered to be done, ordinary nurses and sanitary workers were being punished.
The complaint of nurse Yusupova Dildora was carefully studied by the working group of the Ministry of Health of the Republic of Uzbekistan and an appropriate conclusion was made. According to the conclusion of the working group, Alimova K. and the head of the department, Abdullaev R., were dismissed from their positions due to partial confirmation of their guilt. It was established that the case of “the collusion of the head nurse of the polyclinic with the head of the clinic B. Rakhmonov” is unfounded. The rotation of staff in the department was presented to the chief physician as a proposal of the working group, but this work has not yet been implemented.
However, according to the Labor Law, the employer has the right to change the workplace that is not specified in the employment contract, since the employee’s labor duties have not been changed, prior agreement with the employee is not required (Article 91 of the Labor Code). It follows that the head of the institution has the right to transfer employees from one department to another without their consent, and such a situation, that is, rotation, is not considered a change in working conditions.
